Created in 1957 to take into account legal obligations with regards to compensation of damages caused by motorized vehicles, The Belgian Guarantee Fund (Fonds Commun de Garantie Automobile) has had its missions modified and increased according to European directives and legal or conventional measures.

The conditions whereby the Fund may intervene are regulated by articles 19 bis -2 and next of the law dated 21 November 1989, and modified by the law dated 22 August 2002 (date of effect 19 January 2003) which implements the measures of the 4th directive into Belgian law.

1.       Missions of the Belgian Guarantee Fund

The Fund has two basic missions :

-   Providing information to victims

-   Compensate victims for damages in the cases stated by law

a)  Mission of providing information

1°    Maintaining a register

The Fund maintains a register which must contain the following information :

-      The registration number, date of registration and the duration and validity of the registration in the catalog of vehicles normally based in Belgium.

-      The surname and first name, or denomination, and the address of every owner of a registration of a vehicle normally based in Belgium,

-      The class of vehicle or vehicle registration of vehicles normally based in Belgium,

-      The make, model, serial number, control number, engine size or power, maximum load and date of first registration of the vehicles normally based in Belgium,

-      The insurance policy numbers and date of end of validity,

-      Insurance undertakings covering the use of vehicles for the risks classified in class 10 of point A of the Annex to Directive 73/239/EEC, other than carrier's liability, and their claims representatives,

-      The list of vehicles which benefit from the derogation from the requirement for civil liability insurance cover, as well as the name and the address of the body appointed to compensate the victims²,

-      The name and the address of every claims representative appointed in each country of the E.E.A.

These data are preserved during 7 years after the termination of the registration or the end of validity of the insurance policy. The Fund may transmit this data to equivalent foreign information centres.

2°    Data concerning victims.

a. who may request these details ?

- Persons involved in a traffic accident and their rightful claimants,

-  Persons having a subrogation right or a direct action,

- Other E.E.A information centres,

- Information centres from other countries if they are subject to professional secrecy.

b.    What details are transmitted by the Fund?

-    The name and address of the insurance company,

-    The insurance policy number,

-    The name and address of the claims representative in the country of residence of the victim,

-    The name and address of the owner or usual driver of the vehicle or its holder if the requester proves a legitimate interest,

-    The name and address of the body in charge of compensating damages caused by a vehicle that benefits from the derogation from the requirement for civil liability insurance cover according to the law of the 21.11.1989, or has an equivalent exemption in another member state of the E.E.A.
